§1 Scope
(1) The following General Terms and Conditions apply to all contracts concluded via my online shop between me and consumers or entrepreneurs, in the version valid at the time of the order.
(2) A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to their commercial nor to their independent professional activity (Section 13 BGB).
(3) An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity (Section 14 BGB).
(4) For entrepreneurs, the provisions in Section 11 apply in addition. I do not recognise deviating terms of an entrepreneur unless I expressly agree to their validity in writing.
§2 Contracting party, conclusion of the contract, storage of the contract text
(1) These rules apply to orders placed via my online shop https://grafikus-coffeetec.de.
(2) The purchase contract is concluded with:
Grafikus Coffeetec, owner Torben Schnieber
Richard-Wagner-Straße 43
82538 Geretsried
Germany
Telephone: 0176 43 41 26 64
E-mail: grafikus@grafikus-coffeetec.de
(3) The presentation of the goods in my online shop is not a legally binding offer, but a non-binding invitation to place an order.
(4) The order is placed in the following steps:
1) Selecting the desired goods and clicking on „Add to cart“
2) Checking the details in the cart and clicking on „Proceed to checkout“
3) Ordering with a customer account (login with email address and password) or as a guest without a customer account
4) Entering the billing and delivery address and selecting the payment method
5) Checking all details once more and correcting them if necessary
6) Submitting the binding order by clicking the „Order with obligation to pay“ button
By submitting the order, you make a binding offer to conclude a purchase contract. Until then, you can correct your details at any time using the back button of your browser or the links in the ordering process, or cancel the ordering process by closing the browser.
(5) I confirm receipt of your order immediately by an automatically generated email (order confirmation). With this email I accept your offer.
(6) I store the contract text and send you the order data and these General Terms and Conditions by email. You can view the General Terms and Conditions at any time at https://grafikus-coffeetec.de/agb/ . If you ordered with a customer account, you will find your previous orders under „My account“ → „Orders“. If you ordered as a guest, the contract text can no longer be accessed via the online shop once the order has been completed.
§3 Prices, shipping costs, payment, due date
(1) The prices stated include German statutory VAT. For deliveries to countries outside the European Union, I do not charge German VAT; it is deducted in the cart as soon as the delivery country has been determined. For deliveries to dealers in other countries of the European Union in accordance with § 4 (1), I also do not charge German VAT (tax-exempt intra-Community supply); it is deducted at checkout as soon as a valid VAT identification number has been entered.
(2) Shipping costs are added. They depend on the delivery country, postcode and weight and are shown in the cart and before the order is submitted.
(3) You can pay by prepayment (bank transfer), credit card (Visa, Mastercard, American Express), PayPal, Klarna, Apple Pay or Google Pay. You can see which payment methods are available for your order at checkout.
(4) For payment by prepayment, the purchase price is due immediately after conclusion of the contract. You will receive the bank details with the order confirmation.
(5) A minimum order value applies to orders. It is shown in the cart.
§4 Delivery area and delivery
(1) I deliver to Germany and to the countries outside the European Union offered at checkout. Deliveries to other member states of the European Union are currently made exclusively to dealers who provide a valid VAT identification number and confirm when ordering that they will resell the goods in unchanged form. Deliveries to consumers and to businesses that use the goods themselves are currently not possible to other member states. Customers from other countries of the European Union can order from me with a delivery address in Germany.
The following also applies to deliveries to dealers in other countries of the European Union:
a) For deliveries to dealers in other member states of the European Union, the buyer is the party making the goods available on the market in the country of destination for the first time. The buyer assumes the producer obligations there under packaging law and, where the goods fall within their scope, under the law on electrical and electronic equipment and batteries, in particular registration and participation in the respective take-back schemes.
b) If the buyer falsely states when ordering that the goods are purchased as a dealer for unchanged resale, the buyer shall indemnify me against all costs, fees and fines incurred by me under packaging law as a result of this false statement.
c) If the buyer's statement that the goods are purchased for resale is not or no longer accurate, the buyer is obliged to inform me before placing any further order.
d) I reserve the right to reject or cancel orders for delivery to other countries of the European Union if I have indications that the goods are not intended for resale. In this case, I will refund any payments already made in full.
(2) Unless otherwise stated in the product description, all items are ready to ship immediately. I usually ship on the same or the next working day. Working days within the meaning of these General Terms and Conditions are Monday to Friday, excluding public holidays.
(3) Unless a different delivery time is stated in the product description, delivery within Germany takes place within 5 working days at the latest, to other countries of the European Union within 10 working days at the latest, and to countries outside the European Union within 20 working days at the latest. For payment in advance, the period begins on the day after the payment order is issued to the transferring bank; for all other payment methods, on the day after the contract is concluded. If the end of the period falls on a public holiday at the place of delivery, the period ends on the next working day.
(4) Usual transit times with DHL Paket Premium International: Switzerland and Liechtenstein 2–3 working days, United Kingdom 3–4 working days, Norway 4–6 working days, USA 5–8 working days. These are guide values from DHL; in practice it often takes longer, especially for countries outside the EU due to customs clearance. I ship small items as Warenpost International; the transit time may then be longer, but remains within the period under paragraph 3. The period under paragraph 3 includes the usual duration of customs clearance in the country of destination.
(5) I ship every order complete in one consignment; there are no partial deliveries.
(6) For consumers, the risk of accidental loss and accidental deterioration of the goods passes to you only upon handover of the goods, even in the case of sale by dispatch. For entrepreneurs, Section 11 (2) applies.
§5 Customs, taxes and duties for deliveries outside the European Union
(1) For deliveries to the USA, I charge a customs and handling fee of 15% of the total of the goods value and shipping costs. This fee covers US import duties as well as the costs of customs clearance and handling. It is shown in the cart and at checkout before you complete your order. I ship using the DHL service “Postal Delivered Duty Paid” (PDDP), so your parcel is delivered with duties already paid, and as a rule no further import charges will be due on delivery.
(2) For deliveries to all other countries outside the European Union, import charges, customs duties, taxes or other fees of the country of destination may apply. These are borne by the recipient; they are usually collected on delivery. I do not bear or refund them. Please enquire with the relevant authorities about possible costs before ordering.
(3) Deliveries to countries outside the European Union are exempt from German VAT as export deliveries; I therefore do not charge German VAT on these orders.
(4) Each consignment is accompanied by the information required for customs (customs declaration CN23, commercial invoice).
§6 Retention of title
The goods remain my property until the purchase price has been paid in full. For entrepreneurs, Section 11 (5) applies in addition.
§7 Right of withdrawal for consumers
Consumers have a right of withdrawal in accordance with the following provisions:
Instructions on withdrawal
Instructions on withdrawal
You have the right to cancel this contract within fourteen days without giving any reasons.
The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the goods.
To exercise your right of withdrawal, you must inform me
Grafikus Coffeetec, owner Torben Schnieber, Richard-Wagner-Straße 43, 82538 Geretsried, Germany, phone: +49 176 43 41 26 64, email: grafikus@grafikus-coffeetec.de
by means of a clear statement (e.g. a letter sent by post or an email) of your decision to withdraw from this contract. You may use the attached model withdrawal form for this, but this is not mandatory.
You can also exercise your right of withdrawal online at https://grafikus-coffeetec.de/vertrag-widerrufen/ . If you use this online function, I will send you an acknowledgement of receipt without delay on a durable medium (e.g. by email), with information on the content of the withdrawal statement and the date and time of its receipt.
To meet the withdrawal deadline, it is sufficient for you to send your notification of the exercise of the right of withdrawal before the withdrawal period has expired.
Consequences of the revocation
If you withdraw from this contract, I shall reimburse you all payments I have received from you, including delivery costs (with the exception of the additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by me), without undue delay and at the latest within fourteen days from the day on which I received the notification of your withdrawal from this contract. For this reimbursement, I will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this reimbursement.
I may withhold the reimbursement until I have received the goods back or until you have provided proof that you have sent back the goods, whichever is the earlier.
You shall send back or hand over the goods to me without undue delay and in any event no later than fourteen days from the day on which you inform me of the withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired.
You bear the direct costs of returning the goods. For goods that cannot normally be returned by post due to their nature, these costs are estimated at a maximum of approximately 100 EUR.
You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that was not necessary to check their nature, properties and functioning.
End of revocation

§9 Warranty and guarantee
(1) The statutory rights for defects apply. For entrepreneurs, Section 11 (3) and (4) apply in addition.
(2) For used goods, the limitation period for consumer claims for defects is one year from delivery of the goods, provided that you were specifically informed of this before placing your order and expressly and separately agreed this with me. The shortening does not apply to claims for damages under Section 10 (1) and (2) or to defects that were fraudulently concealed.
(3) For B-stock and used goods, I describe known deviations (e.g. signs of use, cosmetic defects) in the product description. Towards consumers, such deviations are only deemed agreed if you were specifically informed of them before placing your order and expressly and separately accepted the deviation.
(4) If a manufacturer’s guarantee exists for an item, you will find the details in the product description. Your statutory rights for defects are not affected by a guarantee.
(5) If goods are delivered with obvious transport damage, please complain about such defects to the delivery agent as soon as possible and contact me as soon as possible. If you fail to do so, this has no consequences whatsoever for your statutory claims; however, you help me to assert my own claims against the carrier or the transport insurance.
§10 Liability
(1) I am liable without limitation in cases of intent and gross negligence, for injury to life, body or health, under the provisions of the Product Liability Act and to the extent of a guarantee I have assumed.
(2) In the event of a slightly negligent breach of an essential contractual obligation, my liability is limited in amount to the foreseeable damage typical for the contract at the time the contract was concluded. Essential contractual obligations are those whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely.
(3) Otherwise, my liability for slightly negligent breaches of duty is excluded.
§11 Special provisions for entrepreneurs
(1) Entrepreneurs do not have the right of withdrawal under Section 7.
(2) The risk of accidental loss and accidental deterioration of the goods passes to you upon handover of the goods to the shipping service provider.
(3) For new goods, including B-stock, the limitation period for claims for defects is one year from delivery of the goods. For used goods, claims for defects are excluded. These restrictions do not apply to claims for damages under Section 10 (1) and (2), to fraudulently concealed defects, to claims under a guarantee or to recourse claims under Sections 445a, 445b and 478 BGB.
(4) If you are a merchant within the meaning of the German Commercial Code, the duty to inspect and give notice of defects under Section 377 HGB applies.
(5) I retain ownership of the goods until all claims arising from the ongoing business relationship have been settled in full. You may resell the goods subject to retention of title in the ordinary course of business; you hereby assign to me the resulting claims against third parties in the amount of the invoice. I accept the assignment. You remain authorised to collect these claims as long as you properly meet your payment obligations towards me.
(6) If you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from this contract is my place of business in Geretsried. However, I am also entitled to sue you at your general place of jurisdiction. The place of performance is Geretsried.
§12 Contract language
The contract language is German. The English version of the shop is for information only; the German version is authoritative.
§13 Applicable law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer and have your habitual residence abroad, you retain the protection of the mandatory consumer protection provisions of your country of residence.
§14 Dispute resolution
I am neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
